General Terms and Conditions | Status 01.2022
These terms and conditions form the basis for all services and offers of Flying Steps Academy, hereinafter referred to as FSA. Any deviations from these terms and conditions require the written consent of FSA. The GTC are accepted with the registration and automatically with each participation in the course offer of the FSA. The GTC apply to any use of the facilities, courses and offers of FSA, regardless of the place, time and manner of their implementation, unless otherwise stated in the respective contracts.
§ 1 Definitions
In the following, the contract holders or their legal representatives are referred to as participants of FSA in a gender-neutral manner. The use of dance offers (hereinafter Classes) by the Participant shall be effected by means of so-called tickets. This is a digital product.
§ 2 Conditions of Participation
In order to participate in the Classes offered by the FSA, registration on the website of the FSA is necessary. Participation in classes of the FSA can be made up to four weeks in advance either by telephone, via the website or via the FSA App. This booking can be cancelled up to 60 minutes prior to the start of the Class as an early cancellation at no charge. Cancellation up to the start of the Class is considered a late cancellation and will be charged 1 ticket.
§ 3 Offers of the FSA
The prices valid at the time of entry apply (the current price list of the FSA can be viewed on the homepage www.flyingsteps-academy.de). The FSA reserves the right to change prices. The prices include the statutory value added tax. In case of an increase or decrease of the legal value added tax, Flying Steps Entertainment GmbH is entitled to adjust the prices accordingly. The classes of the FSA are suitable for different levels and target groups - recommendations can be seen in the online schedule. Exceptions are possible, but require the unconditional agreement with the management of the FSA or with the responsible coach. If, due to force majeure such as pandemics, on-site classes are not possible, online classes will be offered in their place, which, as a service provision of the FSA, thus replaces all offers. All contract customers of the FSA will be granted access to the online classes here via mail or app.
§ 3.1 Single Tickets
One-way tickets entitle the holder to attend one class at a time on the premises of the FSA. They are valid for 6 months from the date of sale, after which they can no longer be used. One-way tickets can be purchased on site or in the online store of FSA under the conditions applicable there.
§ 3.2 Vouchers
Vouchers can be purchased on site or in the online store of FSA under the conditions applicable there. They can be used for all FSA Classes and can be activated within a period of 6 months from the date of sale. Activation is understood as the first visit to a class. After the expiry of the period, vouchers or corresponding tickets can no longer be used.
§ 3.3 8 Tickets
With the purchase of 8 tickets, the participant is entitled to attend eight classes of the FSA. They are valid for 6 months after which they can no longer be used. 8 tickets can be purchased on site or in the online store of the FSA. They are not transferable.
§ 3.4 Monthly flat rate
A monthly flat rate entitles the holder to unlimited participation in the classes of the FSA within a validity period of 30 days. Age and level-related restrictions must be observed. The validity period begins at the time of activation. It is possible to date the activation into the future. The monthly flat rate can be purchased on site or in the online store of the FSA under the conditions applicable there.
§ 3.5 Term subscriptions
A prerequisite for the conclusion of a subscription is a duly completed entry declaration with a legally effective signature by the subscriber. There are three different subscription models: S, M and L. The subscriptions have a term of three months and are automatically extended by the set term if no written notice of cancellation is received two months before the end of the term. The allocated number of tickets, 13 tickets for the S subscription and 26 tickets for the M subscription, can only be redeemed within the contract period. The subscriber is free to choose how and how often to redeem the tickets. Unused tickets expire at the end of the contract period. All tickets are personal. The subscription L does not include any restriction on the number of visits to classes. Course registration is possible via the online booking system and via the FSA app Payment for subscriptions is made by direct debit with a monthly debit of the partial fees due. If payment is made on site or by bank transfer, the total amount is due at the beginning of the corresponding contract period.
In Subscription-L, participation in classes of the FSA can be transferred to a guest in the event of a verifiable absence or illness of the contract holder of more than four weeks. This transfer can only take place upon written request. This request - as well as the contact details of the guest - must be communicated to the Academy management.
As of 01.02.2020, a one-time admission fee of 15€ will be charged for an initial registration. Each new member who takes out a subscription will also receive a Flying Steps Academy T-shirt. No one-time admission fee will be charged retroactively.
§ 3.6 Annual subscriptions
The purchase of an annual subscription is only possible through the online store according to the conditions that apply there. There are three different annual subscription models: S, M and L. The annual subscriptions have a term of one year and end automatically, no separate cancellation is necessary. The term begins at the time of activation. It is possible to date the activation into the future. Assigned ticket quotas - 13 tickets for the annual subscription-S, 26 tickets for the annual subscription-M - have a validity of 3 months and are assigned four times within the total term. The participant is free to choose how and how often to redeem the tickets. Remaining ticket contingents expire if they are not used within the validity period. The annual subscription L does not include any restriction on the number of visits to classes, but in the event of a longer absence, the contract can be transferred to a guest if the relevant contact details are provided to the Academy management. Course registration is possible via the online booking system and via the Academy app. Unused tickets expire at the end of the term.
§ 4 Prices/contributions/payment procedure
The current prices of the FSA can be viewed on the homepage. With the exception of annual subscriptions, FSA offers can also be paid for in cash or by debit or credit card on site. For term and annual subscriptions, the total amount for the corresponding model is due in this case. If monthly direct debit is selected as the payment method, the partial amount will be debited at the beginning of the month. In the event of a return debit note, a processing fee of 8 euros will be incurred and the direct debit procedure will also be discontinued until the outstanding amount has been settled. In the event of a change of account, the participant undertakes to notify the new bank details in writing without delay.
§ 5 Cancellation
The contract for a term subscription is automatically renewed for the respective contract term if not cancelled at least 2 months before the end of the term. The cancellation must be sent in writing by mail (registered mail), FAX (confirmation of receipt) or scanned by email (confirmation of reading) to the following address:
§6 Amendment of the contract
An amendment to the contract must be submitted in writing and requires a valid signature (for minors, the signature of the legal guardian).
A change of the contract (increase of the service) is possible on every 1st of the next month. A reduction of the service is equivalent to a cancellation and is only possible at the end of the contract period. The cancellation period of 2 months before the end of the term applies.
§7 Warranty and insurance
The FSA is open all year round, including public vacations and vacation days, and the current schedule applies, which can be viewed on the website or via the app. During the Berlin summer vacations, the FSA reserves the right to offer a vacation schedule that deviates from the regular course times for up to 4 weeks. This will be published on the FSA website at least 4 weeks before the start. During the official Christmas vacations of the state of Berlin, the FSA remains closed. In exceptional cases and for internal events, the closing times will be announced via the FSA app.
The FSA management reserves the right to cancel courses if the minimum number of participants is not reached or if the scheduled coach is not available. The selection and use of coaches is the responsibility of the FSA. The management of the FSA reserves the right to use coaches as substitutes at its own discretion; the same applies to changes of rooms at short notice.
The FSA is not obligated to notify participants of course or room schedule changes. Participants must find this out on their own and will not be personally notified.
Class scheduling is up to the coaches themselves.
If a participant is unable to attend classes due to illness that lasts longer than 1 month, he/she may redeem his/her assigned tickets retroactively or take a break from the month, provided an official doctor's certificate is available.
The participant is obliged to pass on the new address immediately if he/she moves.
The instructions of the coaches must always be followed. The participant, or the legal representative (legal guardian), is liable for all damages caused by him/her due to improper use.
§8 Health condition
The participant hereby confirms that he/she is in good health and fit for sport without any restrictions.
In case of doubt, the participant must consult a doctor before registering. The participant is informed that the FSA assumes no liability for his fitness and health and that the training takes place at the participant's own risk.
The participant undertakes to treat all premises, facilities and training equipment with care and to report any damage immediately.
The posted house rules of the FSA must be observed. In case of disregard, the Academy management has the right to remind the participant to comply with the house rules. In case of repeated violation of the house rules, the management of the FSA can exclude the participant for a limited period of time. If the participant does not comply with the house rules even after a temporary exclusion, the participant can be banned from the house for an unlimited period of time.
The instructions of the coaches must always be followed. The participant is liable for all damages caused by him/her due to improper use.
No liability will be accepted for the loss of or damage to clothing brought along as well as for valuables or money.
Found objects will be kept for up to 4 weeks and can be picked up at the Academy. Parents are liable for their children.
§10 Picture and film recordings
FSA reserves the right to make photo and video recordings during the courses and to use them free of charge for its own advertising purposes. This utilization also includes the playout via Instagram, Tik Tok, Facebook and similar social media platforms.
Participants are expressly not permitted to create film and photo recordings unless permission has been obtained from the respective coach. In the event of complaints by third parties, the FSA reserves the right to have the material deleted.
§11 Data protection regulations
In accordance with § 33 of the Federal Data Protection Act, the participant is informed that his/her personal data will be stored electronically for processing purposes. The provisions of the Data Protection Act will be observed. The participant agrees to the electronic use and processing of his personal data to this extent. The transfer of personal data to third parties is not permitted without a special declaration of consent by the person concerned. After an inactivity of more than 12 months, a deletion of the personal data is possible upon written request via the participant's account.
§12 Final provisions
Should any provision be or become void, the remaining provisions shall remain unaffected. The place of jurisdiction for both parties is Berlin.
Additions, amendments or subsidiary agreements to this contract must be in writing. Verbal agreements do not exist.
